Terms & Conditions of Use

Services and Content (“Content”) provided by The Schork Group, Inc. (“TSGI”) are bound by the following Terms and Conditions. If you are entering into this Agreement on behalf of a company, organization or another legal entity (“Entity”), you are agreeing to this Agreement for that Entity and representing to TSGI that you have the authority to bind such Entity and its Affiliates to the Terms & Conditions set forth herein.

Content provided by TSGI is protected by federal and international copyright laws and may not be forwarded or copied (in whole or in part) even for internal use, without TSGI’s advance written approval. TSGI is the owner of the Content and retains all associated proprietary rights. TSGI hereby grants Authorized Users the limited right and license to use the Content provided. Each Authorized User must receive the Content directly from TSGI. Each Authorized User may print out one copy of the Content for their individual use only. Sharing of the electronic or printed copy – or facsimiles thereof – is a direct violation of copyright law.

Content may be quoted from or cited provided that (1) advance written approval is provided by TSGI, (2) appropriate attribution, including TSGI’s copyright notice (Copyright 202X The Schork Group, Inc. / All rights reserved.) is included, (3) any citation or quotation is reprinted in its entirety, and (4) a complete copy of the article, report, or other material in which the quotation or citation occurs is provided to TSGI within ten (10) days of publication. Approval to quote or cite Content is limited to each occurrence and cannot be extended to the same or additional Content without advance written approval from TSGI. Under no circumstances is permission granted to paraphrase or quote out of context any language from the Content, or to alter or modify any of TSGI ‘s images.

All fees are due in full prior to commencement of services. To avoid interruption, this Agreement will renew for consecutive terms unless TSGI or Client notifies the other party in writing at least sixty (60) days prior to the expiration of the Term of their intent not to renew. All fees are non-refundable, absolute, irrevocable, and unconditional.

TSGI does not produce Content on any days that the NYMEX/CME is closed, nor during two weeks of vacation each year, the Friday following U.S. Thanksgiving, and the two weeks of the Christmas/New Year holidays. At its discretion, TSGI may elect to issue abridged formats of the Content.

Content provided by TSGI, including all opinions and recommendations, is intended for informational purposes only. While every effort is made to ensure accuracy, TSGI is not responsible for any actions taken as a result of or on the basis of the analysis and recommendations.

In the event Client or TSGI identifies a material error in the Content at any time after delivery of such Content to Client, TSGI may, as Client’s sole remedy, modify, alter, or otherwise change the Content to correct the information and redeliver such Content.

Services provided by TSGI are believed by TSGI to be reliable, however, SERVICES ARE PROVIDED ON AN

“AS IS BASIS” WITHOUT WARRANTY OF ANY KIND AND TSGI MAKES NO GUARANTEE OR REPRESENTATIONS, EXPRESS OR IMPLIED, TO CLIENT OR ANY OTHER PERSON OR ENTITY AS TO THE ACCURACY, TIMELINESS, COMPLETENESS, OR MERCHANTABILITY OF THE SERVICES. SERVICES ARE PROVIDED ON THE UNDERSTANDING THAT ANY PERSON OR ENTITY THAT ACTS

UPON IT OR OTHERWISE CHANGES POSITION IN RELIANCE THEREON DOES SO ENTIRELY AT SUCH PERSON’S OR ENTITY’S OWN RISK. ALL SUCH WARRANTIES, INCLUDING THE WARRANTY OF FITNESS OF ANY OF THE SERVICES FOR ANY PARTICULAR PURPOSE ARE HEREBY EXPRESSLY DISCLAIMED. THE SCHORK GROUP, INC. ASSUMES NO RESPONSIBILITY FOR LOSS, DAMAGE, COST, OR EXPENSE RESULTING FROM ERRORS OR OMMISSIONS, WHETHER SUCH LIABILITY IS CLAIMED IN CONTRACT, TORT, OR OTHERWISE.
